These Terms & Conditions ("Terms") govern your access to and use of our website and the purchase of fine art prints and products from Franklin Noel Photography ("Company," "we," "us," "our"). By using our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

1. OUR SERVICES

The information provided on our Site is for general informational purposes only. We make no representation that the content on our Site is appropriate or available for use outside the United States. Those who access our Site from other locations do so on their own initiative and are responsible for compliance with local laws.

2. INTELLECTUAL PROPERTY RIGHTS

Our Content

All content on our Site, including photographs, images, text, graphics, logos, and designs, is the exclusive property of Franklin Noel Photography or its licensors and is protected by U.S. and international copyright and trademark laws.

Your Use of Our Content

You may view and download a single copy of content from our Site for personal, non-commercial use only. You may not copy, reproduce, distribute, sell, license, or otherwise exploit any content without our express written permission.

Your Submissions

Any questions, comments, or feedback you send to us become our property and may be used without compensation to you.

3. FINE ART PRINT SALES

Product Descriptions & Color Accuracy

We make every effort to display our fine art prints as accurately as possible. However, we cannot guarantee that your monitor's display accurately reflects the actual color, tone, or texture of the physical print. Slight variations may occur due to monitor calibration, paper type, and printing processes. All print sizes and specifications are approximate.

Availability & Pricing

All products are subject to availability. We reserve the right to discontinue any product or change prices at any time without notice. In the event of a pricing error, we reserve the right to cancel or refuse any order placed at the incorrect price, even if payment has been received.

Payment

We accept Visa, Mastercard, American Express, Discover, and Apple Pay. All payments are processed in U.S. dollars. By placing an order, you authorize us to charge your selected payment method for the total amount, including applicable taxes and shipping fees.

Sales Tax

Sales tax will be added to orders as required by law based on the shipping address.

Order Acceptance

We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to be placed by resellers or distributors.

4. SHIPPING & RISK OF LOSS

  • All fine art prints are shipped via USPS, FedEx, UPS.

  • Risk of loss and title for all products pass to you upon our delivery to the carrier.

  • We recommend purchasing shipping insurance for valuable orders.

  • Delivery times are estimates only. We are not responsible for delays caused by the carrier or circumstances beyond our control.

5. DAMAGED OR DEFECTIVE PRINTS

We take great care in packaging your fine art print. If your order arrives damaged, you must:

  1. Contact us within 48 hours of delivery at franklin.noel.photography@gmail.com.

  2. Provide photographic evidence of the damage (clear photos of the packaging and the damaged print).

  3. Retain all original packaging materials until the issue is resolved.

Upon review, we will, at our discretion, offer a replacement print or a refund. This policy applies only to damage that occurs during shipping and does not cover misuse, improper handling, or normal wear and tear.

6. RETURN POLICY

All sales are final. We do not accept returns or exchanges for change of mind, color preference, or buyer's remorse. Please review all product descriptions, dimensions, and images carefully before placing your order. Your purchase constitutes your acceptance of this policy.

7. COMMERCIAL USE PROHIBITION

All fine art prints purchased through our Site are for personal, non-commercial display only. You may not reproduce, copy, resell, or use any purchased print for commercial purposes (including advertising, product packaging, or merchandise) without our express written permission. Unauthorized commercial use will constitute a violation of our intellectual property rights.

8. USER REPRESENTATIONS

By using our Site, you represent and warrant that:

  • All information you provide is true, accurate, and complete.

  • You are at least 18 years old, or if a minor, you have parental permission to use our Site.

  • You will not use our Site for any illegal or unauthorized purpose.

  • You will not use automated systems (bots, scrapers, scripts) to access our Site.

9. PROHIBITED ACTIVITIES

You agree not to:

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, FRANKLIN NOEL PHOTOGRAPHY AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR YOUR PURCHASE OF PRODUCTS, INCLUDING LOST PROFITS, LOSS OF DATA, OR PERSONAL INJURY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR PURCHASE SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT, NOT TO EXCEED $500.00 USD.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Franklin Noel Photography and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our Site, your breach of these Terms, or your violation of any applicable law or third-party rights.

14. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any legal action arising out of these Terms or your use of our Site shall be brought exclusively in the state or federal courts located in Ingham County, Michigan. You consent to personal jurisdiction and venue in such courts and waive any defense of forum non conveniens. Any claim must be brought within one (1) year of the date the claim arose.

15. PRIVACY POLICY

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms, to understand how we collect, use, and protect your personal information.

16. MODIFICATIONS

We reserve the right to update or modify these Terms at any time without prior notice. Changes are effective immediately upon posting to our Site. Your continued use of our Site after changes are posted constitutes your acceptance of the revised Terms.

17. SEVERABILITY & WAIVER

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions. Our failure to enforce any right or provision does not constitute a waiver of that right.
